These Terms of Use (“Terms”) govern your access to and use of the Makanzy website, applications, tools, and related services (collectively, the “Platform”). Makanzy is a project and brand operated by Sellify (SMC-Private) Limited (“Sellify”, “we”, “us”, or “our”), a company incorporated in Pakistan. By accessing or using the Platform, you agree to these Terms and our Privacy Policy, Cookie Policy, and Disclaimer. If you do not agree, do not use the Platform.

1. Who we are

Makanzy is an online property information and marketplace platform. We provide technology that helps users discover, list, compare, and research real estate opportunities in Pakistan. We are not a licensed real estate brokerage, estate agency, surveyor, valuer, lawyer, bank, or construction contractor unless we expressly state otherwise in a separate written agreement.

2. Eligibility

  • You must be at least 18 years old to create an account or submit listings, inquiries, or other user content.
  • If you use the Platform on behalf of a company or agency, you represent that you have authority to bind that entity.
  • You are responsible for keeping account credentials secure and for all activity under your account.

3. Nature of the Platform — not a party to transactions

The Platform is a venue for information and connections. Sellify and Makanzy do not own, buy, sell, rent, lease, or transfer any property listed on the Platform (unless we expressly identify ourselves as the listing party). We are not a party to any agreement between buyers, sellers, landlords, tenants, agents, developers, or other users. Any transaction is solely between those parties. You must independently verify title, ownership, possession, zoning, society approvals, NOCs, utility status, payment obligations, and all other material facts before committing funds or signing documents.

4. Listings and third-party content

  • Listings, prices, photos, floor plans, project details, area guides, community posts, and similar content may be submitted by third parties (agents, owners, developers, users).
  • We do not guarantee that any listing is available, accurate, complete, current, or lawfully offered.
  • We may review, edit, refuse, delay, or remove content at our discretion, including for policy, quality, or legal reasons, but we have no obligation to do so.
  • Featured, boosted, or ranked placement may be influenced by paid products, relevance, freshness, or other factors we determine.

5. Tools, indices, and estimates

Home loan calculators, construction cost estimators, area converters, price indices, trends, plot-finder maps, and similar tools are provided for general informational and educational purposes only. Outputs are estimates based on assumptions, sample rates, and incomplete data. They are not appraisals, valuations, engineering advice, financial advice, tax advice, or legal advice. Actual costs, payments, plot boundaries, and market values can differ materially.

6. Your responsibilities

  • Provide accurate information and keep listings and profile data up to date.
  • Comply with all applicable Pakistani laws, including property, advertising, consumer, tax, and data-protection rules.
  • Do not post fraudulent, misleading, discriminatory, defamatory, infringing, or illegal content.
  • Do not scrape, reverse engineer, overload, or interfere with the Platform, or use bots without our prior written consent.
  • Do not misrepresent affiliation with Sellify, Makanzy, or any listing party.
  • Obtain all rights needed for photos, documents, and other materials you upload.

7. Agency and professional users

If you list as an agency, broker, or developer, you represent that you are duly authorized to market the property and that all disclosures required by law are made. You remain solely responsible for your licensing, conduct, client funds, and contractual obligations.

8. Intellectual property

The Platform, including the Makanzy name, logos, design, software, and original content, is owned by Sellify (SMC-Private) Limited or its licensors. You receive a limited, revocable, non-exclusive license to use the Platform for personal or internal business purposes in accordance with these Terms. You may not copy, frame, or commercially exploit Platform content without prior written permission, except for fair dealing or other rights that cannot be waived under applicable law.

By uploading content, you grant Sellify a worldwide, royalty-free, sublicensable license to host, display, reproduce, adapt, and distribute that content in connection with operating, promoting, and improving the Platform.

9. Paid services and boosts

Certain features may be paid (for example, listing boosts). Fees, duration, and placement rules are described at the point of purchase. Unless required by law or expressly stated, paid fees are non-refundable once the service has begun or inventory has been consumed. We may change pricing or discontinue products with reasonable notice where practicable.

10. Privacy

Our collection and use of personal data is described in the Privacy Policy. By using the Platform, you consent to that processing as permitted by applicable law.

11. Disclaimers

THE PLATFORM AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, OR THAT DEFECTS WILL BE CORRECTED.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SELLIFY (SMC-PRIVATE) LIMITED, ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR PROPERTY VALUE, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM OR RELIANCE ON ANY LISTING, TOOL, MAP, INDEX, OR OTHER CONTENT — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR PAID SERVICES IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) PKR 10,000, EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER PAKISTANI LAW.

13. Indemnity

You agree to indemnify and hold harmless Sellify (SMC-Private) Limited and its personnel from and against claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of your content, your use of the Platform, your transactions with other users, or your violation of these Terms or applicable law.

14. Suspension and termination

We may suspend, restrict, or terminate access, remove content, or disable accounts if we reasonably believe you have violated these Terms, applicable law, or the rights of others, or to protect the Platform or users. You may stop using the Platform at any time.

15. Third-party links and services

The Platform may link to or integrate third-party sites, maps, payment providers, authentication providers, or advertising. We are not responsible for third-party content, policies, or practices.

16. Changes

We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use after changes become effective constitutes acceptance of the revised Terms.

17. Governing law and disputes

These Terms are governed by the laws of Pakistan. Subject to mandatory consumer protections that cannot be waived, courts in Pakistan shall have exclusive jurisdiction over disputes arising from these Terms or the Platform, without prejudice to our right to seek injunctive relief elsewhere to protect intellectual property or confidential information.
